Transport Class Upgrade

I've modernized my transport class but can neither build it or upgrade the older version. I can understand that if I don't have any Legions why I can't build but should I be able to upgrade the older versions?

I couldn't figure out how to unload my existing loaded transports. I ended up moving them to one of my colonies, then decommissioned each one. That put all my legions back in the free pool. Then I build the new transport model and load them up. Might be an easier way, but this was good enough for me.
