My take: Unless our trusted Frogboy stepped out to the local swamp and took that picture himself and had it copyrighted, then there is no infringement.

listened to a spot on npr today that indicated that if you took/made/created it, it is automatically copywrited. one doesn't not need to file for copywrite protection anymore.
